Resumo

O autor procura demonstrar que a profunda inovação que o Código Civil de 1966 trouxe ao ordenamento de direito privado Português, revela sensibilidade ao contributo inovador do direito comercial, no século que o precedeu, absorvendo algumas soluções amadurecidas no âmbito deste ramo especial de direito, mas sem pretender unificar, nem substancial nem formalmente, o nosso direito privado; e que, sob este ponto de vista, não foi até hoje alterada significativamente a estratégia do legislador português, permanecendo o direito comercial com autonomia legislativa, bem como científica e didática.

The author seeks to demonstrate that the profound innovation that the Civil Code of 1966 brought to Portuguese private law reveals sensitivity to the innovative contribution of commercial law in the century that preceded it, absorbing some mature solutions within the scope of this special field of law, but without intending to unify, either substantially or formally, our private right; and that from this point of view, the strategy of the Portuguese legislator has not been significantly altered until now, with commercial law maintaining Legislative, Scientific and Didactic autonomy.
